1. Overview

This website is operated by 3rd Alarm Apparel. Throughout the site, the terms “we,” “us,” and “our” refer to 3rd Alarm Apparel. We provide this website, including all information, tools, products, and services available through it, subject to your acceptance of these Terms of Service (“Terms”).

By visiting our website, creating an account, placing an order, or otherwise using our services, you agree to be bound by these Terms and by any additional policies referenced in them, including our Return and Refund Policy, Shipping Policy, and Privacy Policy. If you do not agree to these Terms, you may not access the website or use our services.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you. Shopify is not the seller of the products purchased from 3rd Alarm Apparel and is not responsible for fulfilling our obligations to you.

2. Eligibility and Account Responsibility

You must be at least the age of majority in your state or province of residence, or have the consent and supervision of a parent or legal guardian, to use this website or place an order.

You agree to provide current, complete, and accurate account, billing, shipping, and payment information. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring through your account. Please notify us promptly if you believe your account has been used without authorization.

You may not use our products, website, or services for any illegal or unauthorized purpose or violate any applicable law.

3. Products and Product Information

We make reasonable efforts to display product descriptions, colors, images, measurements, and other details accurately. However, colors and appearance may vary due to screen settings, garment dye lots, printing methods, production processes, and other normal manufacturing differences. Product images may include mockups and are provided for illustration.

Garment measurements and size charts are approximate. Fit can vary by brand, style, fabric, and individual preference. Customers are responsible for reviewing the applicable size chart and product description before purchasing.

We reserve the right, without prior notice, to change product descriptions, pricing, available colors, materials, production partners, specifications, or availability; limit product quantities; discontinue products; or refuse a sale when reasonably necessary. We do not guarantee that every product or variation will remain available.

4. Made-to-Order Products and Customer Order Responsibility

Most or all products sold by 3rd Alarm Apparel are made specifically after an order is placed. By submitting an order, you confirm that you have carefully reviewed and approved the selected product, design, size, color, quantity, personalization, shipping address, and all other order details.

Orders may enter production shortly after they are placed. Changes and cancellations are not guaranteed and may be unavailable once production has begun. Unless we agree otherwise in writing, an order already in production cannot be changed or canceled.

Customer ordering mistakes are not product defects or fulfillment errors. Subject to applicable law, we do not accept returns, exchanges, cancellations, or refund requests resulting from:

  • selection of an incorrect size, color, style, design, or quantity;

  • incorrect spelling, wording, dates, names, numbers, or other personalization submitted or approved by the customer;

  • an incomplete or incorrect shipping address supplied by the customer;

  • failure to review a product description, size chart, mockup, or proof;

  • fit preference, buyer’s remorse, or a change of mind; or

  • any other incorrect selection or information provided by the customer.

All personalized, customized, limited-run, and made-to-order products are final sale except when the product qualifies for replacement under Section 10.

5. Orders, Acceptance, and Cancellation by Us

An order confirmation acknowledges that we received your order; it does not guarantee acceptance. We may reject, limit, hold, or cancel an order for reasons including suspected fraud, payment issues, pricing or listing errors, inventory or production limitations, prohibited conduct, unauthorized use of intellectual property, inability to verify eligibility for a restricted product, or an order that appears intended for unauthorized resale.

If we cancel an order after payment has been collected and before the product has been fulfilled, we will refund the amount collected for the canceled portion of the order. We may contact you using the email address or telephone number provided with the order to verify information.

6. Pricing, Payments, Taxes, and Promotions

Prices are shown in U.S. dollars unless stated otherwise. Prices, discounts, and promotions may change without notice. The price charged is the price displayed at checkout when the order is submitted, subject to correction of obvious errors.

You agree to pay all charges associated with your order, including product prices, shipping charges, and applicable taxes. By providing a payment method, you represent that you are authorized to use it and authorize us and our payment processors to charge the total shown at checkout.

Discount codes and promotions are subject to their stated terms, may not be combined unless expressly allowed, have no cash value, and may be modified or ended at any time. Discounts cannot be added retroactively after an order is submitted unless we choose to do so.

7. Shipping, Delivery, and Address Accuracy

Production and delivery dates are estimates, not guarantees. Delays may occur because of carrier operations, weather, holidays, supply interruptions, customs, incorrect addresses, or events outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. We are not responsible for delays, losses, or additional costs caused by an incorrect or incomplete address supplied by the customer. If a package is returned to us because of an address error, refusal, or failure to claim it, the customer may be responsible for additional shipping or reproduction costs before the order is resent.

When tracking shows a package as delivered but the customer cannot locate it, the customer should promptly check with household members, neighbors, the delivery location, and the carrier. We will reasonably assist with available information, but replacement of a package confirmed as delivered is not guaranteed unless required by law.

International customers are responsible for customs duties, import taxes, brokerage fees, and other charges imposed by the destination country unless checkout expressly states otherwise.

8. Restricted, Member-Only, and Organization-Related Products

Certain products may be limited to verified members, supporters, chapters, organizations, or other authorized purchasers. By purchasing a restricted product, you represent that you are eligible and authorized to purchase and possess it.

We may request reasonable verification before producing or shipping a restricted item. We may cancel and refund an order if eligibility cannot be verified or if we reasonably believe the purchase or use would be unauthorized, misleading, or harmful to the applicable organization.

Unless expressly stated, references to organizations, occupations, military branches, public-safety roles, clubs, or communities do not imply endorsement, sponsorship, or affiliation.

9. Custom Artwork, Personalization, and Customer-Submitted Content

If you submit text, photographs, logos, graphics, artwork, names, insignia, or other content for a custom product, you represent and warrant that:

  • you own the content or have permission to use, reproduce, and provide it to us;

  • our use of the content to fulfill your order will not violate any copyright, trademark, privacy, publicity, contractual, or other right; and

  • the content is accurate, lawful, and not threatening, defamatory, obscene, deceptive, or otherwise prohibited.

You grant us and our production partners a limited, nonexclusive license to reproduce, modify as technically necessary, and use the submitted content solely to review, produce, fulfill, and support your order. This license does not transfer ownership of your content to us.

We may reject or cancel custom work that we reasonably believe is unlawful, infringing, hateful, threatening, fraudulent, or otherwise inappropriate. You are responsible for claims or losses arising from content you submitted without sufficient rights or permission.

If we provide a digital proof, you are responsible for reviewing all spelling, placement, colors, dates, numbers, and design details. Your approval authorizes production. An item matching an approved proof is not defective merely because you later prefer a different design or detail.

10. Damaged, Defective, Misprinted, or Incorrect Products

If a product arrives damaged, defective, materially misprinted, or different from the item ordered because of our error or our fulfillment partner’s error, contact us at 3rdAlarmShirts@gmail.com within seven (7) calendar days after delivery.

Your claim must include:

  • the order number;

  • a description of the problem;

  • clear photographs showing the entire product and the specific issue;

  • a photograph of the garment size label or product label, when relevant; and

  • any additional information reasonably needed to verify the claim.

Do not discard, alter, wear, wash, or return the product unless instructed to do so. We may require the original product to be returned or made available for inspection.

After we verify an eligible problem, we will replace the same product at no additional cost. If the identical product is unavailable, we may provide a reasonably comparable replacement or, when replacement is not reasonably possible, issue a refund for the affected product.

Replacement eligibility does not include customer ordering errors, fit preference, minor color or placement variations consistent with the production method, normal wear, damage caused after delivery, or damage resulting from improper washing, care, storage, alteration, or use.

This section and our separate Return and Refund Policy apply subject to any non-waivable rights provided by applicable law.

11. Intellectual Property

The website and its content—including business names, product names, original designs, graphics, logos, photographs, text, videos, site layout, and other materials—are owned by or licensed to 3rd Alarm Apparel and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the website for personal shopping purposes. You may not copy, reproduce, modify, distribute, publish, sell, license, create derivative works from, scrape, exploit, or use our content or designs for commercial purposes without prior written permission.

Purchasing a physical product does not transfer any copyright, trademark, or other intellectual-property right in the product’s artwork or design.

12. Reviews, Feedback, and Other Submissions

If you voluntarily submit a review, photograph, comment, suggestion, idea, or other non-confidential feedback, you grant us a worldwide, nonexclusive, royalty-free license to use, reproduce, edit, publish, translate, and display that submission in connection with our business and marketing, subject to applicable law and our Privacy Policy.

You represent that your submission is truthful, based on your experience, does not violate another person’s rights, and does not contain unlawful, abusive, misleading, defamatory, or malicious content. We may moderate or remove submissions at our discretion, but we have no obligation to do so.

Do not submit confidential information, sensitive personal information, or content you do not want used publicly through a review or public-facing feature.

13. Prohibited Uses

You may not use the website or services to:

  • violate any law, regulation, or third-party right;

  • infringe intellectual-property, privacy, or publicity rights;

  • submit false, misleading, fraudulent, threatening, hateful, or malicious material;

  • transmit malware, viruses, or destructive code;

  • collect or track another person’s personal information without authorization;

  • scrape, crawl, data-mine, reverse engineer, or interfere with the website or its security;

  • impersonate another person or misrepresent an affiliation;

  • evade purchase limits, eligibility requirements, or security controls;

  • engage in fraudulent chargebacks or payment disputes; or

  • use our products or content for unauthorized resale or unlawful commercial activity.

We may suspend or terminate access, cancel orders, or take other reasonable action in response to prohibited conduct.

14. Third-Party Services and Links

Our website may use or link to services operated by third parties, including Shopify, payment processors, shipping carriers, social-media platforms, analytics providers, and production partners. We do not control every third-party website, service, policy, or practice.

Your use of a third-party service may be subject to that party’s own terms and policies. We are not responsible for third-party content, availability, security, or actions except to the extent responsibility cannot lawfully be excluded.

15. Privacy

Our collection, use, and disclosure of personal information are governed by our Privacy Policy. By using the website, you acknowledge that you have reviewed the Privacy Policy. Shopify and other service providers may process information as necessary to operate the store, complete payments, fulfill orders, prevent fraud, and provide related services.

16. Errors and Inaccuracies

Occasionally, the website may contain typographical errors, inaccurate information, or omissions involving product descriptions, prices, promotions, shipping charges, delivery estimates, availability, or other details. We may correct errors, update information, or cancel affected orders at any time, including after an order is submitted, subject to applicable law. If we cancel an affected paid order, we will refund the canceled amount.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an “as is” and “as available” basis. We do not guarantee that access will be uninterrupted, timely, secure, or error-free, or that all website information will always be complete or current.

Except for the replacement commitment in Section 10 and any warranty or right that cannot legally be excluded, we disclaim all express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Some jurisdictions do not allow certain warranty exclusions, so these exclusions may not apply to you.

18. Limitation of Liability

To the fullest extent permitted by law, 3rd Alarm Apparel and its owners, employees, contractors, affiliates, production partners, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost revenue, lost data, or replacement purchases, arising from use of the website, services, or products.

To the fullest extent permitted by law, our total liability for a claim relating to an order will not exceed the amount you paid to us for the product giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded. Consumer-protection rights vary by jurisdiction.

19. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless 3rd Alarm Apparel and its owners, employees, contractors, affiliates, production partners, and service providers from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful use of the website or services, your violation of these Terms, or content you submitted without sufficient rights or authorization.

20. Termination

These Terms remain effective unless terminated by you or us. You may stop using the website at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, engaged in fraud or abuse, or created risk or possible legal exposure.

Obligations and liabilities incurred before termination survive termination, along with provisions that by their nature should continue, including intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute provisions.

21. Governing Law and Disputes

These Terms and any separate agreement under which we provide services are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except when applicable consumer law requires otherwise.

Before filing a legal claim, you agree to contact us at 3rdAlarmShirts@gmail.com and provide a written description of the dispute and the requested resolution. Both parties agree to make a good-faith effort to resolve the matter informally.

If the dispute is not resolved, any legal proceeding must be brought in a court with lawful jurisdiction in the Florida county where our principal place of business is located, unless applicable law gives you the right to bring the proceeding elsewhere.

22. Severability and Waiver

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain effective.

Our failure to enforce any provision is not a waiver of that provision or of our right to enforce it later.

23. Entire Agreement

These Terms, together with policies and notices posted on the website, constitute the entire agreement between you and 3rd Alarm Apparel concerning use of the website and purchase of products, and replace prior communications or agreements concerning the same subject.

If these Terms conflict with a product-specific written term or promotion, the more specific term controls for that product or promotion. If these Terms conflict with a non-waivable requirement of applicable law, the law controls.

24. Changes to These Terms

We may update these Terms by posting a revised version on this page and changing the effective date. Changes apply prospectively from the posted effective date unless applicable law requires otherwise. Your continued use of the website after revised Terms become effective constitutes acceptance of those revisions.

You are responsible for reviewing the current Terms before using the website or placing an order.
